Terms and Conditions of Booking


Booking: The signing of the Rental Agreement/Booking Form confirms the acceptance of the terms and conditions set forth below and shall be binding on all the persons intending to occupy the property whether or not such persons have signed the booking form. Martin and Donna Fell, the Owners, will confirm each booking as soon as possible after the signed booking form and deposit are received. The confirmation will be sent via email. The booking will be deemed confirmed once a reservation deposit has been received and processed. The reservation deposit is generally 25% of total rental charges. The reservation deposit is non-refundable and is applied toward the rental cost.

Once the Owners have issued the booking confirmation the signatory is responsible for the total price of the rental property as agreed. The remaining balance must be paid 10 weeks before arrival date. If the full balance is not paid 10 weeks prior to arrival date, the Owners reserve the right to cancel the booking. The reservation deposit will be forfeited.


Booking Cancellations: The signatory guest may cancel the booking at any time after it has been confirmed. Cancellation must be made in writing or by e-mail. The following cancellation charges will apply:

The reservation deposit is non-refundable and is applied toward the total rental cost.

-0% refundable if cancelled anytime after reserving the home.

The Owners regret that they are unable to waive any of the cancellation charges above, whatever the circumstances. The Owners recommend that all guests take out adequate cancellation or vacation rental insurance.

If through some exceptional circumstance, which would be rare, it is necessary for the Owners to cancel, the Owners will refund to the guest any monies paid, without interest or further compensation. The owners can also try to assist the guest in finding similar accommodations.


Security Deposit: The security/damage deposit of $500 is done at the 1-2 days before arrival time as an “Authorization Only” HOLD against your Credit Card. Depending on length of stay, an additional "Authorization Only" HOLD may be done in anticipation of the first one expiring, which is then released at approximately the 7 days after departure date. The security deposit “Authorization Only” is released to the signatory guest within 7 days of departure provided there is no damage, loss, or excess cleaning costs, and all policies and terms and conditions are followed as listed in this document. Signing the rental agreement the signatory guest agrees to pay from their security deposit for any loss, damage of any kind to the rental property, or excess cleaning costs, resulting from actions of any member of the party or their guests. In the event of any loss or damage to the rental property in excess of normal use during the rental period including excess cleaning costs, as stated here and within other sections of these Terms and Conditions of Booking, the signatory guest will be held responsible for all additional costs. The signatory guest will be informed of such charges prior to any monies being withheld. In the event that there should be damage or losses to the home of over $500, which would be rare, signatory guest will be informed of such charges.


Early Arrivals and Late Departures:

The villa will be available for occupancy from 4.00 pm on the day of arrival and must be vacated by 10.00 am on the day of departure. Guests are expected to adhere to the previously agreed upon 4:00pm check-in & 10:00am SHARP check-out times as stated in the supplied documents & communications. In most situations, these times are not able to be altered to accommodate guests for ANY reason. These rental homes are subjected to many back-to back departure/ arrivals by travelers on any given day and this 6HR window of time is needed to properly prepare and properly inspect the home by our housekeeping staff for the next guest arrival. If by chance the guest can be accommodated by either check-in or check-out flexibility, a service charge $$ may be charged for this option. An Early Arrival or Late Departure must ALWAYS be scheduled 48hrs in advance with the Mgt. Co. or owners.


Travel Insurance:

We recommend that all guests purchase a travel insurance policy to cover any unexpected family, work, medical, weather, natural disasters (Hurricane), or travel delays. We own just a few vacation homes, and we incur all the normal expenses of home ownership just as you do. We are not a large hotel chain, so we cannot take on the risk of refunding guests outside of our published cancellation policies if they have made the personal decision to not purchase travel insurance. Travelers cannot rely on us to act as your “insurance”. Popular insurance choices are TravelGuard.com, Play Travel Protection offered by Nationwide Insurance or policies offered by Allianze Travel Insurance. Please understand that we are not insurance agents, so although we recommend that you purchase travel insurance, it is up to the guests to understand the rules and limitations of the policy you purchase. In the event you need to cancel your reservation, the cost of any travel insurance purchased is typically not refunded by the insurance carrier. For the utmost flexibility, you should consider a travel insurance policy that offers Cancel-For-Any-Reason (CFAR) coverage. CFAR policies are more costly, and typically will not refund 100% of your costs, but they require little or no proof or reason for why your cancelling. If you were nervous that it might rain on your vacation dates the week before departure, or there was a threat of a Hurricane in the area during your stay, you could utilize Cancel-For-Any-Reason coverage.


Liability: The Owners and Management Company of the property accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodation and all amenities, including the pool is entirely at the user’s own risk. Children must be supervised at all times by responsible adults when using the swimming pool. The Owners or Management Company cannot accept any liability for any loss of rental time due to travel problems, flight delays or cancellations, industrial disputes, or any events that are outside our control, including any form of Force Majeure.


Guest Responsibilities: The home is self-catering; guests are responsible for the property, and are expected to take all reasonable care of it. At the end of the rental period, all equipment, including everything in the home, all walls and furnishings included, must be left clean and tidy. All furniture must be left in place.

The Owners provide some basic items such as initial starter amounts of toilet tissue, paper towel, starter soap, and small toiletries. Guests are ultimately responsible to provide their own toiletries and supplies.

The Owners provide extra linen and towels for the convenience of guest use. Guests are required to launder towels used during their stay and any change of sheets. In order to keep the home pest free, please wash dishes and remove the trash daily. Some Trash bags may be provided by the Owner. The trash bin is the bench that is located outside of the front door. Trash is picked up 7 days a week except National Holidays. All trash in excess of the amount the front trash bench can hold at departure, MUST be taken to the convenient waste disposal sites located throughout the Resort. An extra cleaning fee can be imposed for excess trash left in the home at departure. 

Upon departure there should be no more than one soiled set of towels per person and one soiled set of sheets per bed used plus a small amount of kitchen linens left to be laundered. The dishwasher should also be loaded and started. Beach towels are provided for guest use, as a courtesy, but must be laundered before departure. An extra laundering fee can be imposed on the guest for excess soiled laundry left in the home at departure.

Baby/toddler items, Step 2 Diner, Train Table, and board games are provided for the guests’ comfort and enjoyment free of charge. All that we ask is that you clean these items and return them to proper places before your departure so that the next guest can enjoy them as well. 

Please do not remove the train table and Step 2 Diner and accessories from the game room at any time.
The items and parts are particular to those sets and a complete set has to be ordered to replace just one item. More importantly, the next guests may not be able to utilize the Step 2 Diner or Train Table effectively. Do not allow children to play with real food and drinks in the play area, as this could attract insects, especially in the Florida environment, and lead to unsanitary conditions. 

The Owners have provided an outside Propane (Liquid Petroleum ) Grill on the lanai FREE OF CHARGE. If you choose to use the grill, you are responsible for cleaning it after its use. Grill cleaning is not covered in our management cleaning contract. Please leave it for the next guest as you would want to find it.

However, please note that usage of a gas, charcoal, or any open flame grill is prohibited on the lanai, as this is against fire codes and is hazardous. Gas grills must be used outside in the Grassed area and away from the screened area.


Pool Safety: The Pool Safety Fence is the primary safety feature of this home and should not be removed when children are present in the home. It should be in place anytime when pool is not in use. A door safety device have been provided as an additional safety precaution. Do not tamper with this door device as this is a life saving device required by the State of Florida. Please make sure the pool safety fence is re-installed before your departure.

Glass is not permitted within or near the pool area. Plastic glasses and table ware have been provided for your use. Please note that removal of broken glass from the swimming pool requires complete drainage of the pool and can be very costly. 

Tampering with pool heater box or other pool equipment is strictly prohibited and will result in loss of full security deposit. If any assistance is needed in this area, please contact the management company.


Security: The guest is solely responsible for arming the homes security system in an “AWAY” or “STAY” modes at all times for their own personal protection, the safety of their personal belongings and the owners contents of the home and for locking the doors to the extent of locks available at the property, closing all windows at any time during your stay. A hotel style laptop safe is also provided for your valuables. Please leave the safe unlocked and the door open upon your departure so it is ready for the next guests.


Electrical/Electronics: Do not tamper with any of the electrical systems and electronics, including HVAC systems, Wi-Fi, televisions, etc. Disconnection or Removal of the Game System(s) from the family room or other rooms is prohibited. Please contact the management
company or the owners if you are experiencing any difficulty. We strongly recommend that windows and doors be kept closed at all times to prevent excess humidity within the home. Do not leave any windows or doors open because the HVAC is in the ON position at all times and cannot be turned off. This causes additional strain on the HVAC system, which could cause damage to the system. It also makes it difficult to maintain an optimal temperature and climate within the home and can be very costly. Your home may also be equipped with an HVAC SHUTDOWN system which will turn off the AC system if any Doors are left open for an extended time period.


Occupancy Regulations: Due to state fire regulations, under no circumstances should the occupancy exceed what is posted for the property. Maximum occupancy includes children and infants. Maximum occupancy for the homes vary from 12 to 14 persons depending on the home selected but sleeping accommodations for a maximum of 10- 12 adults and 1 infant in a crib are provided and this is the maximum allowed by owners. Unless previously advised and approved, no more than the maximum number of persons identified during the booking process can occupy the home


Party Size: This property is fully licensed for short-term rental in Florida. Everyone occupying the property must be listed on the booking form, including small children. This is Florida state law. The accommodation cannot be shared, assigned or sub-let and only the persons shown on the booking form are permitted to stay in the property. No pets are permitted. Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults. The Owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid


Parties: This accommodation is provided for the members of the party shown on the booking form. The property shall not be used for parties or large gatherings. The Owners or their Management Company reserve the right to terminate your let immediately and forthwith if this occurs. Additionally, the Owners or their Management Company shall not be responsible for any costs you will incur, nor any compensation, nor make any refunds due to this action


Code of Conduct:

Windsor Hills is a family oriented resort and has a designated “quiet time” between 11 pm and 7 am.

Please respect this request and remember to keep noise minimal, particularly in the open at nights. Noise from talking and music around the pool and elsewhere carries a long way in the mild Florida climate. Guests are encouraged to call the Sheriff and report any excessive noise from neighboring homes. This information is available in the information manual at the home. In the event that anyone in your party behaves in a way which the Owner, Management Company, or law enforcement believes is likely to cause danger, distress or annoyance to anyone else in the community, or damage any property, the Owners or their Management Company reserve the right to terminate your let immediately and forthwith. The Owners or their Management Company shall not be responsible for any costs you will occur, nor shall we pay any compensation, nor make any refunds.


No Smoking:

No smoking is permitted anywhere within the home

(this includes the game room). If smoking outside the home, all doors and windows must be closed at all times. Smoking in the home or outside the home with windows/doors open will result in loss of security deposit and will most likely incur additional charges to sanitize & deodorize the home.


No Pets:

Pets are not permitted within the home or anywhere on the property.

Guests with pets are advised to place their pets at another facility. In the event that a guest brings a pet to the property, the management company/owner may elect to evict the guest from the property with loss of all rental money paid. Pets in the rental home will result in loss of security deposit and will most likely incur additional charges to sanitize the home


Fireworks: The Resort has a Ban on the use of Fireworks on any common property within the resort. This includes our individual property. The resort management has had many complaints of damage from fireworks along with the disruption and mess that they cause.


Force Majeure: As with any vacation, there may be circumstances completely beyond our
control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include but are not limited to destruction of or severe damage to the property. Such circumstances are referred to as Force Majeure. In the event the Owners must declare Force Majeure due to the property not being available, the Owners will do their best to make alternative arrangements for you where possible. If they cannot, or if alternative
arrangements are unacceptable to you, then they will refund all monies paid. This will be the full extent of the Owner’s liability to you in such circumstances, and they shall not be responsible for any other costs connected with any such cancellation, howsoever arising


Rental Period: The signatory guest agrees for all members of the party and the owners permit the rental period to begin and end on the dates shown in the rental agreement. The signatory guest agrees for all members of the party and acknowledges that the rental property is a transient facility and thus their occupancy is permitted only in the status of a “transient guest.” The signatory guest agrees for all members of the party, and also confirms, that no permanent residence is planned or extended by the operator


Management Services: Management Services will be available to you during your stay. Phone numbers, contact information, and instructions will be provided in the home. Please report nonemergency situations during regular business hours, Monday through Friday, approximately 9:00 am to 5:00 pm. Emergency situations should be reported immediately at the phone numbers provided in the Management Manual. If you have any concerns with the condition of the home or its contents upon arrival, this should be brought to the attention of the Mgt. Co. Immediately to be resolved


Owner Access: The Owners or their Management Company shall be allowed access at any reasonable time during your stay.


Law: This contract is subject to and shall be construed in accordance with the laws of The State of Florida and the Osceola County Sheriffs Office and all parties hereby submit to the exclusive jurisdiction of the US Courts
